The Supreme Court on Thursday sought response from Andhra Pradesh Assembly Secretary on her appeal against High Court Division Bench decision to keep her one-year suspension intact.
The Division Bench on March 22 had set aside the earlier High Court Single Judge interim order to lift the suspension against R.K.Roja till final adjudication of the case. The Single Judge was seized of the case after Supreme Court had referred Roja’s plea back to the High Court for expeditious hearing.
A Bench led by Justice V.Gopala Gowda issued notice to the Assembly Secretary and posted the case for hearing on April 19 for final arguments.
In her appeal, Roja contended that her suspension for a period of one year ws ex facie illegal and violative of her fundamental rights. She contended that the suspension cannot be for more than the remainder of the ongoing session. She argued in her petition that the High Court erred by ignoring the fact that separate proceedings for breach of privilege are already under way against her for actions alleged committed by her on the floor of the House on December 18, 2015. She said that the High Court proceeded under wrong impression that her alleged actions justified the wrongful actions of the House in invoking Rule 340 of the Rules.
