Supreme Court convicts V.K.Sasikala in disproportionate assets case – decks cleared for OPS

The Supreme Court of India today on Tuesday convicted V.K.Sasikala, AIADMK general secretary in the Jayalalithaa disproportionate assets case.

A Bench of Justices P.C.Ghose and |Amitava Rao also set aside the acquittal of her co-accused J.Ilaarasi and V.N.Sudhakaran and restored their conviction in the case.

The judgement of the apex court cleared the decks for Pannerselvem (OPS) for the Chief Minister of Tamil Nadu. Sasikala would be disqualified to contest electons for ten years including the four year term she had undergone. The judgement authoried by Justice Ghos held that the trial court conviction of the three accused A2 to A4 on September 27, 2014 has been restored in full along with the consequent directions including payment of fine and attachment of properties.

Fine of Rs. 10 crore::The trial court had sentenced Sasikala, Ilavarasi and Sudhakaran under Section 109 IPC read with Section 13 (2) of the Prevention of Corruption Act — abetment of criminal misconduct of a public servant — to simple imprisonment for a period of four years each and pay a fine of Rs. 10 crore each. In case of default, they would have to further suffer imprisonment for another year.For the offence of criminal conspiracy leading to criminal misconduct of a public servant (Section 120 (B) IPC read with Section 13 (2)) of the Prevention of Corruption Act, all three were sentenced to simple imprisonment for six months and a fine of Rs. 10,000 each.The Division Bench has ordered the convicts to immediately surrender themselves before the police.

Happy movements seen at OPS venue:: Those supporting Pannerselvem have been celebrating at the venue of OPS following the judgment that has paved the way to OPS to become the Chief Minister of Tamil Nadu.

Heavy bandobust posted::In the backdrop of the Supreme Court judgement on Sasikala, heavy bandobust has been posted at Poes Gardens, Raj Bhavan, O.Pannerselvam and other places. Sources said over 20,000 police personnel were deployed for the bandobust duties.

BJP leader Subramanian Swamy said that there is a possibility of Sasikala moving a review petition. If this is so, the same will be referred to the same bench.
