The First Additional Sessions Judge Gummadi Gopichand rejected the plea of Guntur Urban Police to frame additional charges under the Protection of Children from Sexual Offences Act (POSCO) against the three accused in the suicide of Mondi Rishiteswari, a B.Arch. student of Acharya Nagarjuna University College of Architecture and Planning.
Y.Koteswara Rao , the counsel of M.Murali Krishna, father of Rishiteswari said that he would file a petition in the High Court pleading that the accused be charged under POSCO Act. The accused Dumpa Hanisha A-1, Dharavanth Jaicharan A-2 and Narala Srinvas A-3 have been charged u/s 306, 364 of IPC section 4 % 5 of Prohibition of Ragging Act. The counsel said that the victim was subjected to sexual harassment on April 18, 2015 by her seniors while she was still a minor and she turned 18 on April 22, 2015. He added that Rishiteswari was a minor when she took admission in ANU College of Architecture and Planning.
The judge rejecting the charges u/s 8 and 12 of POSCO contented that the victim had not filed any complaint during the time she was a minor and also observed that the Ragging Act itself was an exhaustive one to deal with the case.
