PIL filed challenging withdrawal of case against MLA Ashok Reddy

A Public Interest Litigation was filed in the High Court by ex-servicemen Sheik Mastan Vali challenging the government’s order No. 379 withdrawing the case filed against Giddalur MLA Muttumula Ashok Reddy.

The petitioner made the Secretary ( Home), DGP, District Superintendent of Police and PP of the Additional Judicial First Class Magistrate as respondents along with Ashok Reddy.

It may be recalled that Ashok Reddy won the MLA on YSRCP ticket and later shifted loyalities to TDP. Ashok Reddy and his brother along with his followers staged a dharna in front of Markapuram Police Station with the dead body of his relative. A case was registered against them on July 1, 2014. The government has issued a GO No.379 asking the Public Prosecutor of Giddalur Judicial First Class Magistrate Court withdrawing the case.

The petitioner told the Court that the Public Prosecutor can take a decision of withdrawing the case on his own but not on the orders of the government. But in the instant case, the State government has even issued a Government Order directing the Public Prosecutor to withdraw the case is nothing but interfering into the duties of the PP, he said in the PIL.
