Justice T.Sunil Chowdary of the Hyderabad High Court today in his judgement set aside the election of K.Eeranna of the TDP as MLA of Madakasira in Anantapur in 2014.
The judgement said that Eeranna filed to disclose facts in his affidavit while filing the nomination. He did not reveal that his wife was a government employee and hid information about an FIR filed by a police station in Karnataka in 2002. This was in violation of the provisions of the Representation of People’s Act, it said. Following cancellation of Eeranna’s election, the petitioner – Mopuragundu Thippeswamy of YSRCP who secured the highest number of votes after the former stands elected, it said.
Thippeswamy filed the petition in 2014 seeking to declare the election of Eeranna illegal and unconstitutional. The lawyer of Eeranna contended that the details were not hidden deliberately as charged by the petitioner. He argued that his client got the B form to file nomination in the last minute in the 2014 elections. Those who had filled the forms made some omissions and commissions inadvertently. He presented to the court that the case registered against Eeranna was not a grave and did not come under the Representation of People’s Act. He maintained that his client’s wife was in government service at the time of election notification but she subsequently resigned.
