In a slap to the State government, the Hyderabad High Court judge Justice M.S.Ramachandra Rao has quashed the appointment of Karem Sivaji as the Chairman of AP State SC and ST Commission.
The judge was hearing a writ petition filed by J.Prasad Babu and others who complained that the appointment of Sivaji was illegal. The court found that the government failed to follow a transparent or objective process and remarked that the membership of commission and the Chairmanship cannot be regarded as an instrument of conferring largesse on a chosen few.
The judge said that the appointment of Chairman under AP State Commission for Scheduled Casts and Scheduled Tribes Act, 2003 cannot be based upon general principle of ‘ spoils system’ or pleasure doctrine. The appointment was set aside on the grounds of illegality and procedural impropriety. He said that ‘No evidence is placed before me to show that scrutiny of candidates was done’. The judge directed the government to follow transparent method such as inviting applications from interested persons through advertisement or constituting search committee to suggest suitable candidates.
It may be recalled that the Andhra Pradesh State government has appointed Karem Shivaji as the Chairman of SC/ST Commission in April, 2016. Shivaji is a Dalit Social activist and is the Founder and National president of Mala Mahanadu. Hours after he took oath, a petition was filed by J.V.Prasad in the High Court challenging the appointment resulting the Court served notices of his explanation from the government.
