High Court orders notices to defected MLAs who were made ministers to file counters

Tuesday, July 18, 2017

The Hyderabad High Court has issued notices to the four Ministers N.Amarnath Reddy, Bhuma Akhila Priya, C.Adinarayana Reddy and Sujaya Krishna Ranga Rao who won on YSRCP ticket and defected to TDP and got ministerial berths.

The Court has ordered them to file their counter and posted the case by four weeks. A Division Bench comprising of acting Chief Justice Ramesh Ranganathan and Justice Telaprolu Rajani issued the orders.

It may be recalled that a journalist Tangella Siva Prasad Reddy has filed four co-warrant petitions in the High Court seeking the court to elicit on which grounds, the defected MLAs are enjoying the ministerial berths. Dealing with the petition, the Division Bench has issued the orders. Anand Kumar Kapoor advocate appeared on behalf of the petitioner and put forth his arguments. The advocate for the petitioner informed the court that the defected MLAs have quit the party voluntarily and joined the TDP. Under Anti-Defection Law, those who quit the party primary membership cannot continue in the Assembly. The appointment of these four defected MLAs as Ministers is in violation of the law of the Land, he said. The advocate for the government D.Ramesh informed the court that some petitions were filed on the issue and wanted the court to include the present one to them which was objected by the petitioner advocate.

The Division bench admitted the present case and ordered for notices to the respondents.
