Directs that list of IAS officers let off after ACB probes be made public
Hyderabad, October 1, 2007
The Information Act is again in the news. This time, it is in regard to an application filed by the Managing Director of AP State Warehousing Corporation Md Shafiquzzaman. Md Shafiquzzaman has filed an application on April 26, 2007 with the Public Information Officer of the General Administrative Department requesting a list of officers against whom the Government have dropped action after ACB conducted inquires under Right of Information Act.
Shafiquzzaman approached the Commission after the General Administration Department did not furnish the information sought by him on the ground that revealing such information was exempted from the purview of the Right of Information Act under Section 8(1)(h).
The case came up for hearing before the Chief Information Commissioner CD Arha on Monday. He overruled the contention of the Government and said that the said Section of RTI cannot be invoked as in the case action was already dropped by Government against the officers. He upheld the argument of the complainant that denial of such information will seriously impair the objectives for which the legislation was promulgated. He directed the GAD to furnish the information sought by the complainant within 30 days and report compliance.
