Hyderabad, July 13, 2007

A full Bench of the High Court comprising Justices Bilal Nazki, L Narasimha Reddy and G Yethiajulu on Friday dismissed a petition seeking rial for murder of police officials involved in 'encounters' with naxalites. The majority of the Bench comprising Narasimha Reddy an Yethiajulu said that without a complaint a case should not be initiated against the police.

The other judge, Bilal Nazki held that those involved in encounters should be tried in the same way a court tries any other murder case. Nearly 11 petitions were filed by revolutionary writer P Varavara Rao and civil liberties groups following the Manala encounter in Nizamabad district which took place on March 7, 2005. He said that he was thinking of appealing the matter to the Apex Court.

In a statement, People's Union for Civil Liberties president KG Kannabhiran pointed out that the verdict reversed the earlier judgment of a Division Bench in 1997 comprising Justice Prabha shankar Misra in the case relating to the CPI (ML) Janasakhti State Secretary Madhusudan Raj who was killed in an encounter in 1995. The Bench then held that such killings are homicides and need investigation.
