Low ranked police officers need not act illegal orders from superiors

Panels to receive complaints from police on pressure from higher officials

Former Attorney General and member of the Police Reforms Drafting Committee Soli J.Sorabjee has delivered the 21st Sardar Vallabhabhai Patel Memorial lecture on Saturday. He said that the stage has set that to create a mechanism wherein those influencing the police and interfering in the effective discharge of lower ranked police and influencing them to discharge illegal and unconstitutional orders need not obey. He said such orders that have been issued by superiors will not stand as defence and all those obeying the orders will be treated as equally guilty.

He said that efforts were on to evolve a mechanism wherein committees comprising retired judges and civil society representatives would be constituted to receive complaints from police officials on instances of pressure being mounted on them by their superiors. He further said that the proposed changes in the Police Act will also encompass guidelines pertaining to transfers.
