State Government moves to Apex Court on Muslim quota

The Andhra Pradesh Government on Wednesday moved the Supreme Court challenging a Full Bench Judgment of the AP Government declaring unconstitutional an ordinance providing five per cent reservation for Muslims in education and public employment. It may be recalled that the High Court had held the ordinance void on the ground that the AP Backward Class Commission had taken the Muslims as one class and that the criterion adopted for identifying social backwardness of Muslims was irrelevant on November 7.

In its Special Leave Petition, the State submitted that the High Court ought to have noticed that the commission had conducted extensive survey examined several documents, heard objects and submitted its report. The State conducted that the commission had kept in mine the principals laid down by the apex Court relating to identification of social and educational backwardness. It its larger interest of the people likely to be effected by the judgment, the State Legislative Party prayed for stay of its operation.
