The $50 Million liability claim against the City of Bakersfield, California is for unsafe road design and speed on Truxtun Avenue as a result of the horrific deaths of Mona Aboelghar and Abdalla Aboelghar on black Friday 2006. Truxtun Avenue's 11-inch median served as a launching pad for an oncoming SUV causing the vehicle to crush the Aboelghar vehicle killing Mona and Abdalla and devastating the family.

Bakersfield, CA (PRWeb) March 28, 2007 -- Magdy Aboelghar filed a $50 million liability claim March 21, 2007, against the City of Bakersfield, CA as a direct result of the horrific deaths of his wife, Mona Aboelghar and his 19 year old son, Abdalla, on the day after Thanksgiving 2006. The liability claim is a preliminary step to filing a civil lawsuit in California and is identified as 03-21-07.

According to the Bakersfield Police Department's traffic collision report, the Aboelghar family was driving west on Truxtun Avenue in Bakersfield when an oncoming SUV was launched by a 11-inch median landing directly on top of the Aboelghar vehicle killing Mona and Abdalla Aboelghar.

The traffic collision report indicates Truxtun Avenue in Bakersfield has a 55 mph speed limit. Aboelghar's attorney, Charles Brehmer, states that this road has been the site of numerous crashes, injuries and deaths. The claim filed with the City alleges the unsafe condition of Truxtun is due to an excessive speed limit and unsafe design for the tremendous number of vehicles traveling the road on a daily basis.

The Bakersfield Californian newspaper has recently run articles indicating road design and safety have failed to keep up with the City of Bakersfield's tremendous growth.

Aboelghar wants the road to be fixed and for no other families to suffer. In his words "we do not need any more statistics before action is taken by the City of Bakersfield to fix this unsafe road."
