Brayton Purcell Awarded Over $180,000 in Web Site Plagiarism Suit

San Francisco, CA (PRWEB) May 19, 2006 -- The law firm of Brayton Purcell won the battle against plagiarism of its popular web site, Elder Abuse Information, when an arbitrator awarded a total of over $180,000 in its favor. Without obtaining permission, a competing law firm, Recordon & Recordon, had posted large portions of material from the Elder Abuse Information web site on its own web site. Through its web site developers, Recordon copied the content word-for-word and even used the same graphics and lay-out.

The arbitrator set Recordon's liability at $61,154 and found that it directly infringed the copyrights of Brayton Purcell. The firm's web site developers, Apptomix, Inc and Jonathan Lee, were liable for $122,309. Their employee had added the elder abuse section to the Recordon site, committing willful copyright infringement, according to the arbitrator's decision.

The total monetary award includes development and other web site costs as well as attorney fees. The court had previously entered an injunction, with Recordon's consent, requiring Recordon to delete the offending material from its web site. The original lawsuit was filed in November, 2004 and alleged copyright infringement, false advertising, and unfair competition (Case No. C04-4995-EMC, United States District Court for the Northern District of California).
