LAW MINISTER CALLS FOR STRONG LEGAL MEASURES AGAINST INSURGENCY
New Delhi - December 6, 2001

The Union Minister of Law, Justice and Company Affairs, Shri Arun Jaitley has said the idea of fighting terrorism has been nationally accepted and strong measures against insurgency universally approved. Speaking at an Interactive Session on India's Security: The Legal Challenge at the 74th Annual Session of FICCI here today Shri Jaitley called for a strong legal measure against terrorism if India had to progress fast in tune with emerging globalisation of its economy. The Minister said that there was an extra-ordinary synergy between business and rule of law.

Talking of the shape of the nation that we should be evolving Shri Jaitley said that we must decide what kind of India we wanted in view of growing assault on Indian system and national personalities from insurgency, subversion and terrorism. In this connection the Minister advocated enactment of the Prevention of Terrorism Ordinance (POTO) to fight with iron hands the menace of terrorism. He referred to the loss of lives and assets as a result of insurgency during the last few years in the country and said that over 61000 people lost their lives 9000 security personnel were killed and 5.85 lakh people rendered homeless.

Besides 48000 kilograms of RDX explosives were recovered by the security personnel which were enough to blast every inch of Indian soil. The Minister explained that the RDX recovered excluded the RDX used by insurgents and terrorists in different parts of insurgency infested areas of the country. In addition the Government incurred Rs. 45000 crores to fight insurgency in the country over and above the defence budget. This horrendous situation was impeding hassle-free growth in investment in trade commerce and industry of the country. In this context the Minister called for strong laws to protect rule of law and ensure peace and progress of the nation.

The Law Minister referred to the defunct TADA and said that this law when existed was used upto 4.5 per cent against minorities which was one third of the population of minorities in the country. The Minister discounted any apprehension regarding misuse of POTO and stated emphatically that it was intended to be used against terrorism only. The Minister allayed apprehensions against perceived misuse of POTO against innocent law abiding people.

The Law Minister reiterated the Government's resolute stand that decision making could not be paralysed for want of national consensus to bring about strong law that the country needed in keeping with the United Nations Security Council Resolutions in this regard.

Talking of legal set up and justice delivery system in the country the Law Minister said that several steps were afoot as a corrective measure for expeditious justice delivery system. In this connection the Minister said that the urgent steps were needed so that our people did not erode their faith in the high credibility of Indian Judiciary. The Minister said that the country needed to change and shorten procedural laws for expeditious justices. In this connection the Law Minister referred to the Civil Procedure (Amendment) Bill which was before Parliament now hoping that once it was passed and enforced the Civil Procedure will be rationalised to make civil justice delivery system right from institution to disposal shorter and time bound. The Minister further said that the matter relating to criminal justice was before the Justice Mallimath Committee and it would take some time before the Government took action on measures for expediting criminal justice delivery system.
