INSTRUCTIONS ON AVAILABILITY OF NAMES FOR REGISTRATION OF COMPANIES
New Delhi - December 4, 2001

The Department of Company Affairs (DCA) has said that names that attract the provisions of the Emblems and Names (Prevention of Improper Use) Act 1950 as amended from time to time shall not be made available to companies to be registered under the Companies Act 1956 with the Registrars of Companies (RoCs). In a circular issued to RoCs the DCA has reiterated its earlier circular in this regard issued on November 27 1965 prohibiting them from making available improper names under the said 1950 Act while registering new companies.

This follows a communication from the Department of Consumer Affairs that the 1965 instructions of DCA are not being followed scrupulously by RoCs while making available new names for registration of companies. The RoCs have been advised to take into account the provisions of the Emblems and Names (Prevention of Improper Use) Act 1950 while making names available for registration of companies under the Companies Act 1956. They have been asked to adhere to the Government instructions strictly.
