Charging VHP leader Praveen Togadia for sedition under section 121A by Rajsthan Government is surely such ill-advised misuse of the Act which may initiate a dangerous trend of using provisions for political purposes to suppress voice of dissent and opposition. It is quite usual that politicians in Opposition challenge those in power. Therefore by the scale used in case of Togadia, all opposition leaders are automatically guilty for sedition and liable for life-imprisonment! General public also criticizes ruling politicians. If plea of Rajsthan government may be accepted then most members of public are liable to be prosecuted under section 121A for sedition.

Union government is already embarrassed by ‘misuse’ and ‘use’ of POTA for political revenge interestingly against those supporting the NDA government led by BJP. Therefore it must take immediate action to prevent misuse of various acts especially section 121A for sedition. Provision should be there for stringent counter-action against those responsible for misuse if court rejects such charges. In such an event advocates ill-advising persons-in-power for charges like sedition, should be sacked from all panels in government and public sector undertakings.

Acts of Rajsthan’s Congress Chief Minister against VHP leads to doubts of his acting on behest of BJP to harm his party Congress to lose majority Hindu votes. If Samajvadi MP Thakur Amar Singh can take out swords as per his cast traditions with Sikhs already keeping swords as per their religion, how VHP activists can be stopped from keeping ‘Trishuls’ (tridents) in name of religion? Ashok Gahlot is simply glorifying acts of VHP by his immature actions.
