AP High Court stays single judge judgment on PGMET

May 9, 2014 - Hyderabad

A vacation bench of the Andhra Pradesh High Court comprising Justice R Subhash Reddy and Justice M Satyanarayana Murty on Thursday stayed the judgment of a single judge. The clause II(viii) of the rules that permitted reserving certain seats to categories the categories BC-A, BC-D from women from the common poll category. Polling together the residuary seats be filled by BC candidates did not amount to creating a new class within the BC category, the judge said.

The vacation bench admitting the appeals appeal filed by State Government that contended that judgment in Ritesh Shas case is not applicable to PG seats but applies to MBBS and BDS only and stayed operation of the single judge judgment.

It may be recalled here that several students filed writ petitions challenging the decision of State Government to hold fresh entrance examination as the paper was leaked. The single judge upheld the decision of Government and the present appeal was filed challenging the order of single judge. Now the appeal will be heard after June first week.
