MLA Suman Rathod not ST, says AP High Court
December 24, 2013 - Hyderabad
AP High Court dismisses the petition of Suman Rathod challenging the decision of the District Collector that she does not belong to ST but belongs to BC.
The Andhra Pradesh High Court on Tuesday agreeing the contention of the District Collector ruled out that the Khanapur MLA is not ST.
It may be recalled that the Supreme Court in January 2011 passed the interim directions while hearing a petition filed by him challenging the declaration of her election from the Khanapur Assembly segment in Adilabad as in valid due to the allegations that she did not belong to ST. The State Government had conducted a probe following the directions of the court and submitted a report that stated that Rathod was a native of Maharashtra where the Lambadas were treated as Backward Class. The High Court had cancelled the caste certificate given by the Adilabad Collector on October 23, 2009 and the Collector ruled that the MLA could be termed as belonging to the BC and not SC and was challenged in the High Court.
Suman Rathod challenged the decision of the District Collector which the High Court dismissed.
