AP High Court reserves orders on appointment of Information Commissioners


October 22, 2013 - Hyderabad

A Division Bench comprising of Justice Ashutosh Mohunta and Justice Dama Seshadri Naidu of the AP High Court on Tuesday reserved its orders on a PIL challenging the appointment of M Ratan, C Madhukar Raj, S Prabhakar Reddy and P Vijay Babu as State Information Commissioners.

The PIL was filed by city social activists CJ Karira and G Bhargavi. DV Rao counsel for the petitioners argued that the appoints were in violation of Section 15 of the Right to Information Act and in addition to the directions of the Supreme Court in the Namit Sharma case. He said that the State Government did not consider the objections of the Opposition leader Nara Chandrababu Naidu against the appointments and also did not cite the reasons as to why it chose to reject the applications of other other candidates. The counsel said that at the time of appointment of M Ratan, he was in government service while Vijay Babu openly declared that he was local to the Congress. Defending the appointments, the counsel for State Government N Sridhar Reddy said that appointments stating that all the questions raised by the petitioner were already reviewed by the Supreme Court in another case in which this court had set aside the appointments of another four information commissioners, S Imtiaz Ahmed, and M Vijay Nirmala following which the apex court stayed the judgment.
