An Australian man escaped contempt charges by a whisker when his extremely embarrassing mobile phone ring tone rang out at full volume in a packed courtroom.

Sydney, Oct 4 : An Australian man escaped contempt charges by a whisker when his extremely embarrassing mobile phone ring tone rang out at full volume in a packed courtroom.

The decorum and etiquette in the Ipswich Magistrate's call-over court was crushed as the sound of a woman experiencing heightened sexual pleasure rang out loudly for between 10 to 20 seconds.

People sitting in the public gallery made great efforts to mask their embarrassment as well as laughter.

Acting magistrate Roger Stark also tried to overlook the ring tone and address the case before him.

The message repeated a woman moaning: "Oh, yeah ... yeah ... oh, yeah ... do it to me," reports News.com.au.

The man, whose mobile created the awkward situation, could be seen trying to unsuccessfully turn off his phone.

The incident took place an hour after prosecutor Constable Jo Little warned people seated in the public gallery to make sure their mobile telephones were switched off or risk having them confiscated by the presiding magistrate.

While the magistrate chose not to take any action against the man, he could have held him to in contempt of court.

The man could have also found himself charged with causing a public nuisance - which carries a maximum sentence of six months jail.
