Pakistans Chief Justice Abdul Hameed Dogar has observed that the failure on the part of assemblies to perform their function has always led to martial law in the country.

Islamabad, Nov 21 : Pakistan's Chief Justice Abdul Hameed Dogar has observed that the failure on the part of assemblies to perform their function has always led to martial law in the country.

Chief Justice Dogar, who was hearing petitions against emergency rule and the PCO, made the observation in response to petitioner Zafarullah Khan's argument that the reasons cited by President Pervez Musharraf for imposing emergency rule could have been placed before Parliament for a solution.

Responding to Zafarullah's argument that the solution to every problem was laid down in the Constitution, Justice Ejaz Yousaf observed that the Constitution did not provide a solution in a situation where organs of the state interfered in each others affairs and indulged in confrontation.

Zafarullah said that emergency could only be proclaimed by the President and not the Army Chief.

Chief Justice Dogar, however, said that Parliament had allowed Musharraf to hold both offices, the Daily Times reported.
