The National Human Rights Commission (NHRC) has asked the UP Government to pay fifty thousand rupees to a victim of detention and torture.
New Delhi, May 29 : The National Human Rights Commission (NHRC) has asked the UP Government to pay fifty thousand rupees to a victim of detention and torture.
The Commission's direction came on a complaint filed by one Shashi Kumar Upadhyay of Varanasi, who alleged that his brother Naveen Upadhyay, who was picked up by the local police on February 11, 1999 was illegally detained at the police station till February 19, 1999.
An inquiry by the Investigation Division of the Commission further substantiated the allegations. Finally S.K. Saxena, DIG (HR), UP submitted a report in the year 2003 wherein it was candidly admitted that the allegations of the complainant were correct.
Following this on August 29, 2007, the Commission issued show cause notice to the State government. However, the State government has not responded to the notice despite a reminder. On December 31, 2007, a communication from the Secretary, UP, Government was received in the Commission, which sought two months time. Till date the State government has not submitted any reply to the notice.
Hence, the Commission said that as the DIG (HR), UP, had already admitted illegal detention of the victim, the State government had nothing to say against the grant of monetary relief to the victim.
Taking into account the period of detention and other circumstances, the Commission recommended that the State government should pay fifty thousand rupees to the victim and submit compliance report along with proof of payment.
