The Union Cabinet today gave its approval for the amendment of the Part I of the Schedule to the Constitution, under article 342 of the Constitution.

New Delhi, Oct 25 : The Union Cabinet today gave its approval for the amendment of the Part I of the Schedule to the Constitution, under article 342 of the Constitution.

The Cabinet has decided to insert the following provision and Explanation in the Part at the end:

"Provided that the children, who are born to inhabitants of Lakshadweep in any other place in the mainland of India shall be deemed to be inhabitants born in the islands, if such children settle permanently in the islands.

Explanation : The term " settle permanently" shall have the same meaning as defined under Clause 3(I)(d) of Lakshadweep Panchayat Regulation, 1994."

The Clauses 3(I) (d) of the Lakshadweep Panchayat Regulation, 1994 would read as follows:

"3(I): A Gram Sabha shall consist of persons registered in the electoral rolls relating to an Island or group of islands comprising the area of Village ( Dweep Panchayat):

Provided that a person shall be disqualified for being a member of the Gram Sabha, if he -

(d) is not ordinarily a resident within the Island for which the Gram Sabha is established.

Explanation : For the purposes of clause (d) a person shall be deemed to be "ordinarily resident" in an Island if he has been ordinarily residing in such Island or is in possession of a dwelling house therein ready for occupation."

"The list of Scheduled Tribes of Lakshadweep will be modified as per approval of the Cabinet as children, who are born to inhabitants of Lakshadweep in any other place in the mainland of India shall be deemed to be eligible for Scheduled Tribe status in Lakshadweep. This will benefit the children of the Scheduled Tribes of Lakshadweep, who have been residing away from Lakshadweep due to medical, educational or job requirements etc. resulting in their children having been born in the mainland," a release issued by the Cabinet stated.
