The Central Vigilance Commission (CVC) disposed of 393 cases referred to it for advice in July, 2007.
New Delhi, Aug.20 :The Central Vigilance Commission (CVC) disposed of 393 cases referred to it for advice in July, 2007.
Further, the investigations by the CTE unit of the Commission resulted in recoveries to the tune of Rs. 3.82 crores during the month to the Government.
Action recommended by the Commission and action taken by the administrative authorities on its recommendations are given below:-
(i)The Commission advised launching of prosecution against 2 officers from Central Board of Excise and Customs during the month.
(ii)In pursuance of the Commission's advice tendered earlier, the competent administrative authorities issued sanctions for prosecution against 8 officers during the month. This included 3 officers from D/o Industrial Policy, 2 officers from Andrew Yule and Co., 1 officer each from D/o Posts, Central Board of Direct Taxes and M/o Urban Development.
(iii)Based on the investigation reports submitted by the CBI and the Chief Vigilance Officers, the Commission had advised initiation of major penalty proceedings in 212 cases. It included 44 officers from Central Board of Excise and Customs, 34 officers each from Public Sector Banks and MCD, 27 officers from Chandigarh Administration, 26 officers from M/o Railways, 8 officers from Khadi and Village Industries Commission, 5 officers from Sasastra Seema Bal, 4 officers each from Container Corporation of India Ltd, Council of Scientific and Industrial Research and NCCF, 2 officers each from Insurance Companies, Central Board of Direct Taxes, Central Coalfields Ltd., M/o Textiles, Kendriya Vidyalaya Sangthan and DDA, 1 officer each from IRCON International Ltd., Calcutta Port Trust, NHAI, D/o Economic Affairs, Madras Fertilizers Ltd., Council for advancement of Peoples, D/o Education, D/o Supply, Food Corporation of India and M/o Urban Development.
(iv)Based on the inquiry reports submitted by the Commissioners for Departmental inquiries, borne on the strength of the Commission, and the departmental inquiring authorities, the Commission advised imposition of major penalty against 71 officers. It included 17 officers from Public Sector Banks, 11 officers each from Insurance Companies and DDA, 8 officers from M/o Railways, 6 officers from BSNL, 3 officers each from Central Board of Excise and Customs and M/o Defence, 2 officers each from Central Warehousing Corporation and Central Industrial Security Force, 1 officer each from D/o Telecommunications, ITDC Ltd., Coal India Ltd., D/o Mines, Rashtriya Ispat Nigam Ltd., M/o Urban Development, Central Reserve Police Force and Sasastra Seema Bal.
(v)Based on the Commission's advice tendered in earlier months, suitable major penalty was imposed on 46 officers comprising 22 officers from Public Sector Banks, 5 officers from M/o Railways, 4 officers from MTNL, 3 officers from CPWD, 2 officers each from BSNL and Central Board of Excise and Customs, 1 officer each from Oriental Insurance Co. Ltd., Council of Scientific and Industrial Research, NTPC, Employees State Insurance Corporation, Food Corporation of India, DDA, M/o Urban Development and MCD.
(vi)During the month, the Commission had advised initiation of minor penalty proceeding in 117 cases and imposition of minor penalty in 30 cases. The administrative authorities, on the advice of the Commission have imposed minor penalties on 92 officials. The Commission also advised closure/exoneration of the charges in 165 cases during the month.
(vii)In April 2004, the Govt. of India had designated the Central Vigilance Commission as an agency to receive written complaints or disclosure on any allegation of corruption or of misuse of office by any employee of the Government under Govt. of India Resolution on Public Interest Disclosures and Protection of Informer. On receiving such complaints, the Commission forwards them to the concerned departments for investigation and report without disclosing the identity of the complainant. Accordingly, during July' 2007 the Commission had forwarded 04 such complaint for a report to the respective organisations. 08 complaints have been filed being petty/anonymous/pseudonymous, 09 complaints have been sent for necessary action. Upto July'2007, 34 complaints have been sent for investigation and report, 81 complaints have been sent for necessary action and 53 have been filed. Departmental action has been advised in 56 cases.
(viii)Apart from the complaints received under Govt. of India Resolution on Public Interest Disclosures and Protection of Informer, during July'2007, the Commission had forwarded 52 complaints having verifiable and documentary evidences for investigation and report to the departments/organizations concerned. The Commission also forwarded 582 complaints which were either administrative in nature or having no vigilance angle for necessary action/disposal to the departments/organizations. Besides, 361 complaints which have been found either petty in nature or, anonymous/pseudonymous have been filed. Upto July'2007, 442 complaints have been sent for investigation and report, 3746 have been sent for necessary action and 2363 have been filed. Commission has advised departmental action in 51 cases.
(ix)The Commission had decided that all complaints against senior officers which were unduly delayed by the organisations would be taken up for direct Inquiry by its own officers, under the provisions of CVC Act, 2003. Accordingly, total 229 cases have been taken up for Direct Inquiry and reports have been received in 111 cases upto July' 2007 on such complaints.
(x)During the month the Commission gave vigilance clearance in 37 cases of appointments in different organizations.
The CBI filed charge-sheets in 141 cases after receipt of sanction of prosecution. CBI also received sanction for prosecution in 56 cases from various Departments. This matter is being closely monitored by the Commission to secure sanction from the organisations concerned in a reasonable period of time, as directed by the Hon'ble Supreme Court. However, sanctions for prosecution are still delayed.
