A Chief Justice K G Balakrishnan headed bench said it could not pass any specific order or direction on the basis of Justice Sri Krishna Commission's findings.
The apex court asked the petitioner, the action committee for implementation of Srikrishna Commission, and others to file the affidavit within six weeks.
"If there is complete failure of justice, it will certainly be looked into," the apex court said.
The petitioners had alleged that the accused in the 1992 communal riots, which preceded the 1993 Mumbai serial blasts, have gone scot-free.
Justice B.N. Srikrishna headed commission investigated causes and apportioned blame for the Mumbai riots, before submitting its report in 1998.
