Judge rejects bid to move Britneys case to federal court

A federal judge rejected the New York-based attorney Jon Eardleys claim that he represented Britney Spears and sent the troubled pop stars conservatorship case back to probate court.

Washington, Feb 27 : A federal judge rejected the New York-based attorney Jon Eardley's claim that he represented Britney Spears and sent the troubled pop star's conservatorship case back to probate court.

U.S. District Judge Philip Gutierrez in a ruling said that Eardley , who claimed that the local system's decision to temporarily place dad Jamie Spears in charge of her affairs had violated her civil rights, is not Spears' attorney and has no authority to act on her behalf.

"Mr. Eardley fails to explain why he can bring this claim for her in the first instance. He cannot," E! Online quoted Gutierrez, as stating in the ruling.

"Mr. Eardley had no authority to remove the case from state court. He is neither a party nor a defendant. While he claims to be Ms. Spears's attorney, the probate court...found that she was incapable of retaining her own counsel," he added.Gutierrez further rejected a request filed by Britney's father Jamie Spears' camp demanding 43,000 dollars in attorneys' fees from Eardley to compensate for the extra court time.
