Paris Hilton and Benji Madden accused of hit and run

Paris Hilton is again at the centre of a controversy - this time for a hit and run case.

Washington, Apr 26 : Paris Hilton is again at the centre of a controversy - this time for a hit and run case.

The socialite and her boyfriend Benji Madden are facing legal action from a photographer in Los Angeles, after reportedly running over his foot with their car on April 24.

The incident took place at the premises of Foxtail club in West Hollywood, and according to reports, a loud scream was heard when the duo pair drove away from there.

In fact, on TMZ.com's video of the incident, which also shows the alleged victim's black and white checker Van's tennis shoe, someone's heard saying: "He's alright, he's a paparazzi," reports Usmagazine.com.

The victim, Glen Gurniak, filed papers Friday with the L.A. Sheriff's Department.

"There were too many people that side of the car so he swung the wheels in my direction on the other side of the car and got my foot trapped under the wheel," Gurniak told Splash News Online.

He added: "I yelled at him: 'Dude, you've pinched my foot under the wheel, don't drive, don't drive,'" Gurniak said. "He turned and looked at me out of the window and then just drove. I fell to the floor as the car stopped and was just laying on the floor as everyone was screaming at him that he'd run me over."

Sheriff spokesman Steve Witmore said: "The incident is currently under investigation."
