Washington, Sept 29: Actor Kiefer Sutherland has been formally charged with two misdemeanor counts of Driving Under the Influence.
Sutherland was arrested on suspicion of driving under the influence in the early hours of Sept. 25 in Hollywood but was later released on a 25,000-dollar bail.
In addition to the two DUI counts, the city attorney is also seeking to have the Emmy winner's probation revoked from a November 2004 drunken-driving conviction.
Because of his previous DUI conviction, Sutherland faces a mandatory minimum sentence of four days in jail if convicted for this latest incident, which was his fourth DUI-related arrest.
"We have charged Mr. Sutherland with a second DUI offense within 10 years, which we believe also constitutes a violation of the terms of his probation from his 2004 conviction," E!Online quoted Nick Velasquez, a spokesman for the City Attorney's Office, as saying.
Sutherland was sentenced to 60 months' probation, 50 hours of community service and an alcohol-treatment program on the count of DUI in 2004.
"Since he is still on probation from this 2004 DUI, we have also requested that the court revoke his probation and set a probation-violation hearing," Velasquez said.
The '24' star faces up to one year in county jail if convicted and a 1,000 dollar fine. Also, if the court finds him in violation of any terms or conditions of his probation from his 2004 conviction, he could be ordered to serve up to an additional six months in the county jail.Previously, Sutherland was charged with drunken-driving counts in 1989 and 1993. In both cases, he pleaded for lesser charge of alcohol-related reckless driving.
